Do I Have to Use the Estate Agent’s Broker or Solicitor?
Do I have to use the estate agent’s broker or solicitor when buying a home? Many buyers are asking this, especially after this week’s BBC Panorama investigation into estate agent practices.
Shockingly, one of our clients was told their offer wouldn’t be accepted unless they completed a financial assessment with the agent’s in-house mortgage broker. This demand came after we had already provided a full financial appraisal and a valid Agreement in Principle (AIP).
Let’s be clear: this is not required. So, do I have to use the estate agent’s broker? No, and here’s why it matters.
You Don’t Need to Use the Estate Agent’s Broker
Estate agents may encourage you to speak to their in-house broker. Some even suggest it will make your offer stronger. But this simply isn’t true.
If you already have a valid AIP from a regulated adviser, that’s all you need. At Orchard Mortgage Solutions, we provide FCA compliant financial assessments that meet lender expectations. There’s no reason for you to duplicate that work with someone else.
More importantly, you have the right to choose a broker who works for you not one who is tied to the seller.
You Can Also Pick Your Own Solicitor and Surveyor
Estate agents often suggest a solicitor or conveyancer. They may say it will “speed up the process” or help your offer look better. But again, you are under no obligation to accept their recommendation.
Choosing your own solicitor gives you control, independence, and usually clearer communication. Look for a conveyancer who offers fixed fees and works in your best interest, not one who’s paying referral fees to the agent.
The same goes for surveys. Estate agents may push a specific surveyor. However, selecting your own independent RICS accredited surveyor ensures you get an honest, thorough report. This protects you from buying a property with hidden problems.
Why This Matters: Protect Your Buying Power
This week’s BBC Panorama programme highlighted unfair pressure and conflicts of interest in the property industry. Sadly, it’s still happening, just like our client experienced.
When estate agents try to control the entire process from mortgage to legal to survey. It’s often about profit, not service. That’s why it’s so important to understand your rights.
At Orchard Mortgage Solutions, we believe in transparency. We work for you, not for commission. Our advice is independent, tailored, and always in your best interest.
